Consumer guarantees & Australian Consumer Law (ACL)
Where goods and services are supplied to consumers, statutory guarantees under the Australian Consumer Law (Competition and Consumer Act 2010) apply and cannot be excluded. Examples include:
- Services rendered with due care and skill;
- Services fit for the disclosed purpose;
- Goods of acceptable quality and fit for purpose when applicable.
Our contractual terms are subject to these statutory guarantees. If you are a consumer, nothing in our terms will remove your rights under the ACL.
Limitation of liability
Subject to applicable law (including the ACL), our liability for any loss or damage arising from performance of logistics services is limited to:
- the price paid for the service in question; or
- where applicable, the limits of liability under a governing carriage contract or international convention.
We exclude indirect, special or consequential loss to the fullest extent permitted by law.

Terms, carriage rules & accepted conditions
Our carriage and warehousing services are provided under written terms and/or governing carrier conditions. Where applicable, international moves may be subject to:
- Montreal Convention / Warsaw Convention (international air freight)
- International conventions adopted in contracts (as agreed)
- Domestic carriage governed by applicable state and federal transport laws

Customers should ensure packaging and documentation comply with legal and carrier requirements. We reserve the right to refuse carriage of non‑compliant consignments.
Complaints & dispute resolution
We aim to resolve complaints promptly and fairly. Steps:

- We will acknowledge within 5 business days and propose a resolution pathway.
- If unresolved, disputes may be escalated to external dispute resolution or small claims processes as applicable under Australian law.
Regulatory compliance & licences
Sparkoptionplace complies with applicable Australian transport, customs and biosecurity requirements. Key obligations include:
- Customs and quarantine declarations as required by Department of Home Affairs and Department of Agriculture, Fisheries and Forestry;
- Adherence to chain-of-custody and temperature control standards for cold chain shipments;
- Insurance and cargo acceptance policies consistent with industry practice.
